You may, however, download material that is required for the sole purpose of assisting you in placing an order. Conditions of Service

1 – General

1.1 Unless otherwise agreed in writing, these conditions (“Conditions”) apply exclusively to each referral of supply of services relating to takeaway food delivery (“Services”) via www.eatquickr.co.uk (“the Website”) and between the Takeaway establishment (“the Takeaway”) and the user (“the User”) (together “the Parties”) for the life of the relationship.

1.2 The price of the Services (“the Price”) is the Takeaway’s quoted price. The Takeaway is only bound by orders which it has accepted electronically. An accepted order can only be cancelled or varied with the Takeaway’s consent.

2 – Restaurant & Takeaway access

Our ability to invest in a high quality web platform depends on our restaurants and takeaways complying with this Section. All information received by us from your use of eatquickr.co.uk will be used by the Website in accordance with our Privacy & Terms policy Each registration is for a single restaurant/takeaway only

The named contact for the restaurant/takeaway is responsible for all use of eatquickr.co.uk or anyone else using the access ID and for preventing unauthorised use of the access ID. If you believe there has been any breach of security such as the disclosure, theft or unauthorised use of the access ID or any payment information, you must notify us immediately by e-mailing us at takeaways@eatquickr.co.uk

If you are a registered user of eatquickr.co.uk then you may choose to use the “Remember me” log in feature that enables you to be logged in automatically to eatquickr.co.uk whenever you visit the Website without having to manually log in each time. We recommend that you do not enable this feature on any computer that is or may be used by anyone other than you in order to prevent unauthorized access by third parties to both your access details and features of eatquickr.co.uk personal to you.

2.1 Free Trial Access: where we provide a trial access, we will inform you of the full access price that is payable after the trial period. After the trial, your access will not renew automatically unless you enable your subscription after the end of the trial.

Please note that no more than one free trial per restaurant/takeaway is allowed in any twelve month period. We reserve the right to cancel any trial access immediately if we become aware that the restaurant/takeaway has already had another trial subscription in the previous twelve months.

2.2 Payment details: when a restaurant or takeaway purchases access, the restaurant/takeaway must provide us with complete and accurate payment information. By submitting payment details you promise that you are entitled to purchase access using those payment details. If we do not receive payment authorisation or any authorisation is subsequently cancelled, we may immediately terminate or suspend your access to the Website. In suspicious circumstances we may contact the issuing bank/payment provider and/or law enforcement authorities or other appropriate third parties. If the restaurant/takeaway is entitled to a refund under these terms and conditions we will credit that refund to the card or other payment method used to submit payment, unless it has expired in which case we will contact the named contact for the restaurant/takeaway.

2.3 Pricing: the access price will be made clear to you on our sign-up pages or otherwise during the sign-up process and may vary from time to time. You agree to pay the fees at the rates notified to you at the time you purchase your access. Access can be taken out either on an annual or quarterly (or other frequency we offer) access. You can also take out any other fixed term or payment frequency that we may offer from time to time. The currency in which your subscription is payable will be specified during the order process, depending on the service and your country of residence. Eligibility for any discounts is ascertained at the time you subscribe and cannot be changed during the term of your subscription. We will always tell you in advance of any increase in the price of your subscription and offer you an opportunity to cancel it if you do not wish to pay the new price.

2.4 Cancellations by us: eatquickr.co.uk reserves the right to suspend or terminate restaurant access if you breach these terms and conditions. Termination is with or without notice and without further obligation to you. We may also suspend or terminate your access if we are prevented from providing services to you by circumstances beyond our control. If we terminate your subscription for any reason and/or permanently cease publishing .eatquickr.com or cease to provide access services then, unless there are exceptional circumstances, we will provide you with a pro rata refund to your credit card. This means that we will refund you with any amounts that you have paid us in advance that relate to any remaining and unexpired period of your subscription.

3 – Service Fulfilment

3.1 The User must supply sufficient information to enable the Takeaway to proceed with the execution of the Contract.

3.2 Priority Delivery Codes are only valid for fulfilment by validated restaurants/takeaways complying with Section 2

4 – Extraneous Delays

The User must, on request, accept any extraneous delays by the Takeaway in supplying the Services caused by: any breach, default, delay or variation by the User of its obligations under the Contract or these Conditions; any factor beyond the Takeaway’s reasonable control; any change in the particulars of the supply of the Services which the User requires; or any delay caused by the Users’s instructions or the Users’s failure to give the Takeaway adequate information or instructions when the order has been accepted or at any other time.

5 – Limitation of Liability

5.1 www.eatquickr.co.uk (the Website), the Takeaway or the third party links are not liable to the User because of any representation (unless fraudulent) or any temporal warranty (express or implied), temporal condition or other term, or any duty at common law, or under the express terms of the Contract, for:

5.1.1 any loss of service, opportunity, goodwill, enjoyment, revenues, anticipated time savings, expenses, costs or similar loss; and/or

5.1.2 any indirect, special or consequential loss or damage (whether for loss of profit, enjoyment or otherwise); (whether caused by the negligence, breach of contract, tort, breach of statutory duty of the Takeaway, its employees or agents or otherwise) arising out of or in connection with the Contract).

5.2 Any other liability of the Takeaway to the User in contract, tort, breach of statutory duty or otherwise arising out of or in connection with the Contract or any series of Contracts, is limited to the Price received by the Takeaway in respect of the Contract or series of Contracts in question.

6 – Force Majeure

The Website, the Takeaway and the third party links are not liable to the User for any failure or delay in performance of its obligations under the Contract which is beyond its reasonable control including any difficulty obtaining suitable personnel, machinery, adverse weather difficulties and injury to personnel of obligations they have undertaken. The Takeaway will inform the User as soon as reasonably possible of any such occurrence, normally with the offer of alternative arrangements.

7 – Third Parties

Each Contract will only confer rights and benefits on the User and no third party can acquire rights or benefits under the Contract or these Conditions.

8 – Assignment

The Contract may not be assigned by the User, but the Takeaway may assign or sub-contract all or any or its rights or obligations.

9 – Entire Agreement

These Conditions and the documents referred to in them, set out the entire agreement between the Parties and supersede any previous agreements between the Parties relating to the subject matter of these Conditions. The user acknowledges that in entering into a Contract subject to these Conditions, it has not relied on any representation, warranty, agreement or statement not set out in these Conditions and that (in the absence of fraud) it will not have any right or remedy arising out of any such representation, warranty, agreement or statement and that its only remedy for breach of these Conditions is for breach of contract under the terms of these Conditions.

10 – Law and Jurisdiction

English law governs these Conditions and each Contract and the Parties agree to the exclusive jurisdiction of the English Courts.
